Once a Waqf, Always a Waqf: Congress MLA Supports Controversial Claim on Tamil Nadu Village Land

A fresh political storm has erupted in Tamil Nadu over a controversial land ownership issue, as a Congress MLA has publicly supported a Waqf Board’s claim on a large tract of land in a village near Tiruchirappalli. The remarks come in the wake of a long-standing dispute over whether the land in question belongs to private individuals or is classified as Waqf property—a type of endowment in Islamic law.

MLA’s Statement Sparks Outrage

Congress MLA Hassan Moulana, while addressing a local meeting on Sunday, stated, “Once a Waqf, always a Waqf. No individual, government, or political party has the right to alter that status.” The statement came in reference to a 240-acre plot in Melmampatti village, where several families have been cultivating the land for decades.

Moulana further claimed that the land was registered as Waqf property during the British era and any challenge to that would be “an attack on minority rights and religious heritage.”

Waqf Board vs. Locals

The Tamil Nadu Waqf Board earlier submitted documents suggesting the land was endowed to the Board for religious and community purposes in the 19th century. However, residents and local landowners allege they hold patta (title) documents proving legal ownership.

Several families claim they have been living and farming on the land for generations and fear eviction if the Waqf claim is upheld. Tensions have been high since local revenue officials visited the area last week to review land records.

Political Reactions

Opposition parties have slammed the Congress MLA’s comments. The BJP’s Tamil Nadu unit accused the Congress of “playing appeasement politics” and demanded a clear demarcation of religious and public land holdings.

BJP state president K. Annamalai said, “This is not about faith; it’s about the livelihoods of hundreds of Tamil families. No political leader should make sweeping claims that override constitutional and land rights.”

The ruling DMK has remained cautious, calling for a judicial review of the land records and urging people to maintain peace.

Legal Complexity

Legal experts say the issue is layered. Waqf properties are governed by the Waqf Act of 1995, which provides that once land is declared as Waqf, it cannot be sold or transferred. However, disputes often arise when property records are ambiguous or poorly maintained.

A former Madras High Court judge, speaking on condition of anonymity, noted, “Waqf claims must be backed by strong documentary evidence. Blanket declarations without due process risk violating property rights.”

What’s Next?

The Tamil Nadu government has ordered a detailed land survey and asked both parties to submit their claims for review. Meanwhile, the matter is likely to head to court if a settlement is not reached soon.

As debates heat up in the Assembly and local protests continue, the case is quickly turning into a litmus test for how religious rights, historical claims, and modern property laws intersect in one of India’s most legally complex land disputes.
